Terms of Service — Businesses & Donors

What you need to know before donating or sponsoring through Community Fundraising Hub

Version 1.2 Effective: May 2026 Governed by New Zealand law NZBN: 9429053669445

1. Introduction — Who We Are

Community Fundraising Hub ('CFH', 'we', 'us', 'our') is a Charitable Trust Board incorporated under the Charitable Trusts Act 1957 (Incorporation No: 70000374, NZBN: 9429053669445). We connect sports clubs with local businesses and individual donors to fund community sporting activities.

These Terms of Service ('Terms') apply to every business and individual ('you', 'Donor') who makes a donation or sponsorship contribution through the CFH Platform. By completing a donation, you confirm you have read, understood, and agreed to these Terms. All transactions are in New Zealand dollars (NZD).

2. The Nature of Your Donation

2.1 You Are Donating to CFH — Not Directly to the Club

When you donate through a CFH Club fundraising page, your donation is made to Community Fundraising Hub — not directly to the sports club shown on the page. CFH then applies those funds to support the named club's campaign, consistent with CFH's charitable mission.

  • CFH can issue tax receipts for donations (once donee status is confirmed — see Section 3)
  • Funds are managed through a trustee-governed charitable trust with proper financial oversight
  • Donations are protected by the governance framework of a registered NZ charitable entity

2.2 How Your Donation Is Used

CFH retains a Platform Fee of 7% from each donation to fund platform operations. After this fee and Stripe's payment processing costs are deducted, the remaining balance is transferred to the nominated sports club weekly.

Example — Where your money goes

You donate $500 to the Warkworth Netball Club campaign.

  • $35.00 (7%) is retained by CFH as the Platform Fee
  • Stripe's payment processing fee (current NZ rate) is deducted
  • The remaining balance is transferred to the club

2.3 Sponsorship Recognition

If you select a named sponsorship tier, recognition benefits (such as logo placement or mentions in club communications) are the responsibility of the sports club — not CFH. CFH facilitates the donation and campaign page, but cannot guarantee the delivery of offline sponsorship benefits. If a club is unable to deliver a promised benefit, your recourse is with the club.

3. Tax Receipts and Charitable Giving

Donee Status — Not Yet Active (as at May 2026)

CFH has applied for registration with Charities Services NZ and is awaiting approval. Until CFH's registration is confirmed AND a donee organisation number (DT number) is issued by Inland Revenue, donations to CFH do NOT qualify for the NZ donor tax credit.

CFH will notify all donors immediately upon receiving donee status. In the meantime, CFH can provide a donation confirmation for your records only — this is not a tax receipt and does not entitle you to a tax credit.

3.2 Once Donee Status Is Confirmed

  • Businesses and individuals donating $5 or more in a tax year will be entitled to a 33.33% NZ donor tax credit
  • CFH will automatically issue a tax receipt to your email address within 48 hours of processing
  • Tax receipts will confirm CFH's charitable registration number, donee status number, donation amount, date, and donor name
  • Donors can use the receipt to claim their tax credit via their IRD tax return or myIR

Please retain your tax receipt for at least 7 years as IRD may request evidence.

3.3 Your Responsibility for Tax Claims

CFH issues tax receipts in good faith. However, it is your responsibility to ensure you are eligible to claim a donor tax credit. CFH does not provide tax advice. Contact IRD at ird.govt.nz or 0800 775 247 if you have questions.

4. How Donations Are Processed

4.1 Payment Processing

Donations are processed through Stripe. When you submit payment:

  • Your card details are handled directly by Stripe — CFH never receives, stores, or has access to your card number, expiry, or security code
  • Stripe processes the transaction using PCI-DSS compliant infrastructure
  • You will receive a payment confirmation from Stripe at the time of donation
  • CFH will separately issue a donation acknowledgement and (when donee status is active) a tax receipt by email

If you experience a payment failure or technical issue, contact hello@cfh.org.nz. Please do not attempt multiple payments for the same donation.

4.2 Your Information

When you make a donation, CFH collects your name, business name (if applicable), email address, donation amount, and the campaign you are supporting. Your information may also be processed by third-party services CFH uses to operate, including Stripe, Netlify, and Zapier. See our Privacy Policy for full details.

CFH also uses contribution data in aggregate and anonymised form to generate platform-wide insights, improve matching between clubs and business sponsors, and develop community fundraising benchmarks. This data is never linked back to individual businesses or contacts in any external publication or product.

4.3 Sharing Information with the Club

Your name, business name (if applicable), donation amount, and chosen tier will be shared with the sports club whose campaign you supported, so the club can acknowledge your contribution and fulfil sponsorship recognition. Your email address will not be provided to clubs for unsolicited marketing purposes.

5. Refund Policy

5.1 General Principle

Donations to CFH are generally non-refundable once processed, consistent with standard charitable giving practice in New Zealand.

5.2 Refunds at CFH's Discretion

CFH may issue a refund where: you made an accidental duplicate donation; a technical error resulted in an incorrect charge; or you submit a refund request within 72 hours of donation AND the funds have not yet been settled to the Club. Contact hello@cfh.org.nz promptly with your name, email, amount, campaign name, and reason.

5.3 AML/CFT Holds

If CFH has reasonable grounds to suspect a donation may be connected with money laundering, terrorism financing, or fraud, CFH may hold those funds for up to 30 days pending investigation and, if required, report to the NZ Police Financial Intelligence Unit.

5.4 Campaign Cancellation

If a Club's campaign is cancelled before settlement, CFH will notify all donors and offer a full refund to donors who request one within 20 working days. Where no refund is requested, donated funds will be applied to CFH's general charitable purpose.

5.5 No Refund After Settlement

Once funds have been settled to a Club, CFH cannot unilaterally recover them. CFH may assist in mediating between the donor and the club but cannot guarantee a financial remedy.

6. Sponsorship and Business Use

6.1 Ethical Sponsorship

All club campaigns on the CFH Platform are subject to CFH's Ethical Sponsorship Guidelines. By making a donation or sponsorship contribution, you confirm that your business does not operate primarily in any absolute prohibition category under those Guidelines, and is not engaged in illegal activity in New Zealand. CFH reserves the right to decline, reverse, or refund a donation from any business whose involvement would be inconsistent with CFH's charitable purposes.

6.2 Sponsorship Tier Recognition and Logo Licence

If you select a named sponsorship tier, your name or business logo may appear on the Club's public fundraising page and in club communications for the duration of the campaign. By providing a logo or name, you confirm you have the right to grant this licence and that it does not infringe any third party's intellectual property rights. You may request removal at any time by contacting hello@cfh.org.nz.

6.3 No Guarantee of Advertising Outcomes

Sponsorship through CFH is a charitable donation, not a commercial advertising purchase. CFH provides no guarantee of any specific number of page views, social media impressions, or commercial return on your donation.

7. Anti-Money Laundering and Countering Financing of Terrorism

CFH is committed to compliance with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT Act). CFH does not knowingly accept donations derived from illegal activity and reserves the right to decline, reverse, hold, or report any donation it reasonably suspects is connected with money laundering, terrorism financing, or fraud.

8. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • CFH's total liability to any donor for any claim is limited to the amount of that specific donation
  • CFH is not liable for any indirect, consequential, incidental, or special loss
  • CFH is not liable for the conduct of any Club or the delivery of any Club's sponsorship commitments
  • CFH is not liable for any tax outcome resulting from a donation

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other non-excludable statutory right under New Zealand law.

9. Changes to These Terms

CFH may update these Terms from time to time. The current version will always be available at cfh.org.nz/terms-donors. If you make a repeat donation after an update, you are deemed to have accepted the updated Terms. Material changes will be communicated by email to donors where we hold your contact details.

10. Governing Law

These Terms are governed by the laws of New Zealand. Any dispute arising from or in connection with these Terms or a donation will be subject to the non-exclusive jurisdiction of the New Zealand courts. If you have a concern or complaint, please contact us first at hello@cfh.org.nz — we will do our best to resolve it promptly and fairly.
